General Terms and conditions

By making a purchase or by placing an order, the purchaser accepts the present general conditions of Horse Oil Diffusion, abbreviated HOD, which prevail against all general or particular conditions of the purchaser.

ARTICLE 1: PRICE

1.1 - The selling prices of the marketed products are to be considered as excluding VAT (except E.U. citizens)
1.2 - These prices are considered without transport charges.
1.3 - The prices can change at any time and without prior notice.
1.4 - All orders are payable in Euros except by express agreement.

ARTICLE 2: PAYMENT

2.1 - The payment of the delivered products is carried out in cash on reception of the goods and invoice except in the case of a specific agreement to the contrary. Any invoice will ipso jure and without summation carry legal interest from the day of its expiry until full payment. In the event of non-payment by the COMPANY, whether due to bad faith or negligence, the COMPANY will also pay ipso jure and without summation on the part of HOD, damages and interest of 15% calculated on the amount of the invoice or the balance due, with a minimum of 50 Euros.

ARTICLE 3: AVAILABILITY

3.1 - Our offers of products and prices are valid within the limit of available stocks.
3.2 - Within this framework, indications of the availability of the products are provided to you at the moment that you order.

ARTICLE 4: DELIVERY

4.1 - The products are delivered to the delivery address you indicated in your order.
4.2 - The periods indicated are average periods and correspond to processing and delivery times.
4.3 - In the event of articles that are deliverable on different dates in consideration of their availability, the delivery period is based on the longest period.
4.4 - Horse Oil Diffusion cannot be held responsible for the consequences of delayed delivery.

ARTICLE 5: RECEPTION OF THE PARCEL

5.1 - At the time of reception of the parcel, before signing the delivery order, immediately check the parcel in the presence of the deliveryman (packing and contents). In the event of shortages, anomaly, damaged product or parcel, delays, etc?: Immediately write your reservations on the form which is presented to you. You will also have to confirm your reservations to the conveyor by registered letter with acknowledgement of delivery within two working days of reception of the parcel at the latest. 5.2 - The goods travel, in all cases, at the risk of the recipient who must safeguard all possible means of recourse against the conveyor. Any complaint formulated outside the given period cannot be accepted.
5.3 - In the event of mistaken delivery, on our part, of products not corresponding to your order, please state precisely what the problem is and inform us by letter or fax the day of the delivery or within two working days of the delivery at the latest.
5.4 - In the cases foreseen in article 5.3, sending and return expenses will be refunded to you in the event of mistaken delivery.

ARTICLE 6: INVOICING

6.1 - Delivery in Belgium
An itemised bill will be addressed to you with your parcel, the indicated VAT amount allows professionals to recover it.
6.2 - Delivery in Europe (EU) for tax-liable professionals
Application of the intra-Community payment regulation. Communicate to us your intra-Community VAT number before sending, and your invoice will be established excluding Belgian VAT.
6.3 - Delivery in Europe (EU) FOR PRIVATE INDIVIDUALS not liable for tax
We apply the Belgian VAT rate.
6.4 - Delivery outside EU & rest of the world
The invoice will be issued excluding Belgian VAT. On the other hand, you will have to comply with the relevant laws and pay the relevant taxes on entering your country and ensure as a preliminary that the ordered products are authorised for importation into your country.

RETURN  POLICY
6.5  If, for any reason, the consumer should not be satisfied with the delivered products, he has the right to return them,  postage fees at his cost and within 7 work days, following the delivery day.  If he keeps the products, this implies that he totally and irrevocably accepts them.
6.6  Special order merchandise, made to the purchasers' specificities cannot be returned, unless both parties have a specific agreement about this.
6.7  Should the consumer sent back the products, HorseOil Diffusion has to be informed of his intent to return the merchandise, with a recommended letter. All purchased merchandise must be returned in "BRAND NEW" condition, otherwise a refurbishing fee may be required to restore the merchandise to a marketable condition. Goods  returned in a deteriorated state will not be refunded..In case he renounces the purchase, the consumer shall return the goods at his own risks and costs.
HorseOil diffusion has 30 days to refund the purchaser, without further costs.
6.8  HorseOil Diffusion will inspect the returned merchandise within 2 weeks.

ARTICLE 7: GUARANTEE

7.1 - Keep your invoice: it is your proof of warranty.
7.2 - The offered products are in conformity with current Belgian legislation. Horse Oil Diffusion cannot be held responsible in the event of non-observance of the legislation of the country where the products are delivered. You must check the possibilities of importation or use of the products with your local authorities.
7.3 - Horse Oil Diffusion can not be held responsible for failure to execute the order in the event of disturbance, force majeure, running out of stock, total or partial strike especially of the postal service and means of transport and / or communication, flood, riots, attacks, fire?

ARTICLE 8: CUSTOMER DATA

8.1 - In order to meet your needs and to ensure a quality sales department, we maintain a record of certain administrative elements that concern you. This information is essential for processing and routing your orders. Information thus collected is of purely internal use and will never be revealed to third parties.

ARTICLE 9: DISPUTES

9.1 - Any litigation relating to our commercial relations as a whole falls under the exclusive jurisdiction of the commercial court of the district of Nivelles, Belgium.
